FOR IMMEDIATE RELEASE
October 1, 2026
HB 1681 establishes a clearer state framework for tiny homes and yurts while preserving local land-use, building-code, water, and wastewater requirements.
Fitzwilliam, NH — New Hampshire’s HB 1681, Chapter 330, took effect September 13, 2026. The law establishes statutory definitions and a framework for tiny houses, tiny houses on wheels, and yurts as residential structures.
What the law defines
Under RSA 674:82, a qualifying tiny house is a detached building used or intended for human habitation, with permanent provisions for living, sleeping, eating, cooking, and sanitation. It must have 600 square feet or less of floor area, excluding lofts; comply with the tiny-home provisions of the state building code; and be constructed on a stable ground surface or foundation.
A tiny house on wheels (THOW) is defined as a tiny house built on a trailer chassis without motive power. When constructed for human habitation, a THOW is not considered a camp trailer or recreational vehicle.
Local requirements still apply
RSA 674:83 provides that a municipality may permit an innovative housing structure on an individual house lot where single-family dwellings are allowed, or for use as an accessory dwelling unit, subject to all applicable land-use requirements. The law also treats these structures as single-family dwellings or accessory dwelling units for zoning purposes and retains applicable state requirements for drinking-water supply and wastewater treatment and disposal.
That means the law creates a clearer framework, but it does not make every property automatically suitable for a tiny home. Before choosing a design or committing to a purchase, property owners should check local land-use requirements, building-code obligations, and site-specific water and wastewater needs.
